1. Introduction

1.1 These Terms and Conditions govern your relationship with Aeternum Fine Art (“Gallery,” “we,” “our,” or “us”) when you purchase artwork, commission a piece, visit our premises, participate in our exhibitions, or otherwise engage with our services.

 

1.2 By purchasing artwork, entering our premises, commissioning work, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

 


 

2. Telephone Sales

2.1 Artwork Information and Verification

  • We will provide accurate descriptions of artwork available for purchase, including dimensions, medium, creation date, and condition.

  • High-resolution digital images may be provided upon request before a purchase is finalized.

  • Condition reports are available upon request for specific works.

2.2 Purchase Process

  • All telephone purchases will be confirmed in writing via email, including artwork details, price, payment terms, and shipping arrangements.

  • Verbal agreements are binding only after written confirmation is sent and acknowledged by the buyer.

  • For purchases exceeding [INSERT AMOUNT], we may request identity verification or additional documentation.

2.3 Payment

  • Payment methods include credit card, bank transfer, or electronic funds transfer.

  • Credit card payments by telephone are processed in line with PCI DSS (Payment Card Industry Data Security Standards).

  • A non-refundable deposit of [10%] is required to secure the purchase, with the balance payable before delivery or collection.

  • Receipts will be provided electronically for all transactions.

2.4 Cooling-Off Period

  • Buyers have a 48-hour cooling-off period after confirming a telephone purchase in writing.

  • Cancellations within this period are refunded in full (minus any transaction fees).

  • Cancellations after this period will result in forfeiture of the deposit.


3. Site Visits

  • We reserve the right to refuse admission at our discretion.

  • Visitors must behave respectfully; disruptive or inappropriate conduct may result in removal.

  • Unless explicitly permitted, photography, video recording, and flash use are prohibited.

  • Food and beverages are not permitted in exhibition areas unless provided by member of staff.


4. Artwork Sales (In-Person)

  • All works displayed are offered for sale unless marked Not for Sale (NFS).

  • Prices are listed in GBP and include applicable taxes unless otherwise stated.

  • Payment methods: credit card, debit card, bank transfer, or certified cheque (personal cheques may be accepted at our discretion).

  • A non-refundable deposit of 10% is required to secure a purchase, with the balance due before collection or delivery.


5. Artwork Reservations

  • Works may be reserved for up to 48 hours without deposit.

  • For longer reservations, a non-refundable deposit of 25% of the purchase price applies.

  • If the purchase is not completed within 14 days, the artwork may be released for sale and the deposit forfeited.


6. Commissions

  • Commission requests are subject to artist availability and approval.

  • A written agreement will outline specifications, timelines, and payment terms.

  • Standard payment schedule:

    • 33% deposit (non-refundable) upon signing,

    • 33% on approval of sketches or concept,

    • 34% on completion and prior to delivery.

  • Artists retain the right to use images of commissioned works for portfolio, promotion, and exhibition unless otherwise agreed in writing.


7. Shipping and Delivery

  • Shipping quotes are provided in writing before purchase finalization.

  • Buyers must confirm shipping address and instructions in writing.

  • Insurance is included in shipping quotes unless agreed otherwise.

  • Tracking details will be provided upon dispatch.

  • Title passes to the buyer only upon receipt of full payment and delivery.

  • We package artworks with care but are not responsible for damage if the buyer declines our recommended shipping method.

  • Buyers are responsible for accurate delivery details; additional costs due to errors are their responsibility.


8. Returns and Refunds

  • All sales are final once payment is processed.

  • Claims for damage in transit must be made within 48 hours of delivery, with photographic evidence.

  • If shipped using our preferred carrier, we may repair, replace, or refund at our discretion in the event of damage.

  • For telephone sales, if the artwork received substantially differs from the written description, a return and refund may be requested within 7 days of receipt.


9. Authenticity and Provenance

  • We guarantee the authenticity of all works sold. Purchases include a certificate of authenticity issued by the artist and/or the Gallery.

  • Provenance records are maintained and available upon request for works with ownership history.

  • We comply with all applicable laws regarding cultural property and do not knowingly sell works with questionable provenance.


10. Copyright and Reproduction Rights

  • Purchase of artwork does not transfer copyright or reproduction rights.

  • Buyers may not reproduce, publish, or create derivative works without written consent from the rights holder.

  • Personal, non-commercial photography of purchased works is permitted.


11. Privacy Policy

  • We collect personal information solely for transaction processing, delivery, and communication.

  • Credit card information is processed securely and not stored beyond the transaction period.

  • We do not sell or share your personal data with third parties except as required by law.

  • Buyers may opt out of marketing communications at any time.


12. Limitation of Liability

  • Our liability shall not exceed the purchase price of the artwork or service in question.

  • We are not liable for indirect, incidental, or consequential damages.

  • While we take reasonable precautions to protect visitors and works, we are not liable for injury or property damage on premises except in cases of gross negligence.


13. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of the United Kingdom.

  • Disputes will first be addressed through good faith negotiation. Failing resolution, parties agree to pursue mediation before arbitration or litigation.


14. Amendments

  • We reserve the right to update these Terms at any time without prior notice.

  • Updated versions will be posted on our website and available upon request.
